1. Applicability to entrepreneurs and definitions of terms

(1) The following general terms and conditions apply to all deliveries between us and a consumer in the version valid at the time of the order.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed.

2. Formation of a contract, storage of the contract text

(1) The following regulations on the conclusion of a contract apply to orders via our Internet shop P77.SHOP.

(3) The presentation of the goods in our online shop does not represent a legally binding contract offer on our part, but is only a non-binding invitation to the consumer to order goods. By ordering the desired goods, the consumer makes a binding offer to conclude a purchase contract.
(4) When an order is received in our online shop, the following regulations apply: The consumer submits a binding contract offer by successfully going through the ordering procedure provided in our online shop.

Ordering is done in the following steps:

1) Select the desired goods
2) Confirm by clicking the "Order" button
3) Check the information in the shopping cart
4) Press the button "to Checkout”
5) Login to the online shop after registering and entering the applicant information (e-mail address and password).
6) Re-examination or correction of the entered data.
7) Binding dispatch of the order by clicking on the button "order with costs" or "buy"
Before the binding dispatch of the order, the consumer can press the "Back" button contained in the internet browser he is using button to return to the website on which the customer's details are recorded and correct input errors or cancel the ordering process by closing the internet browser after checking his details. We confirm receipt of the order immediately by an automatically generated email ("order confirmation"). With this we accept your offer.
(8) Saving the text of the contract when ordering via our Internet shop: We save the text of the contract and send you the order data and our general terms and conditions by e-mail. You can view the terms and conditions at any time under terms and conditions. You can view your past orders in our customer area under My Account --> View my orders.

3. Prices, shipping costs, payment, due date

(1) The prices shown include statutory VAT and other price components.
(2) The consumer has the option of paying by invoice, PayPal, Twint, credit card, Klarna, Blick, EPS, Giropay, IDEAL, Multibank, Sofort, SEPA, Google Pay or Apple pay.
(3) If the consumer has chosen to pay by invoice, he undertakes to pay the purchase price immediately after conclusion of the contract. >

3.1 Payment period

The payment deadline is 7 days from the invoice date. Payment methods
Delivery will only take place after receipt of payment.

3.2 Default of payment on invoice

If the customer does not meet their payment obligations in whole or in part, all outstanding amounts that the customer owes to P77 under any title are due immediately (in the case of advance payment within 7 calendar days of the 1st reminder). and P77 can claim them immediately and stop further deliveries of products to customers. 

P77 charges a processing fee of CHF 25 for the 1st reminder and a processing fee of CHF 50 for the 2nd reminder. In the case of unsuccessful reminders, an additional processing fee of CHF 200 will be charged. Furthermore, the invoice amounts will be assigned to a company commissioned with collection, the debt collection office or Intrum. In this case, an effective annual interest rate of up to 20% can also be charged on the invoice amount owed from the due date. The company commissioned with the collection will claim the outstanding amounts in its own name and for its own account and may charge additional processing fees.

3.3 Payment invoice

Ordered products remain the property of P77 or the retailer until full payment has been made to P77. P77 or the dealer is entitled to make a corresponding entry in the retention of title register. Before the transfer of ownership, pledging, assignment as security, processing or transformation is not permitted without the express consent of P77.

3.4. Changing the order or canceling it

Orders oblige the customer to accept the products and services. Subsequent changes or cancellations of customer orders can be accepted by P77 or the retailer at their own discretion and an administrative fee of 20% of the canceled order value, but at least CHF 60 or €60, as well as any loss in value of the canceled products since they were ordered invoice.

3.5. Retention of title

We reserve title to the goods until the purchase price has been paid in full

4. Privacy

The data you transmit will be treated as strictly confidential by P77. The data will only be passed on to third parties, such as our shipping company, if this is necessary for the one-time order processing. There is no liability for the security of the data during transmission over the Internet or for possible criminal access by third parties to files in the web shop.

Due to our technical situation, the data and images you have sent to us will be stored until the next database reorganization and then deleted. Your data will only be deleted beforehand if you request it in writing, including proof of identity by post.

7. Liability and disclaimer

Liability is based on the applicable legal provisions. However, P77 Shop is in no case liable for slight negligence, indirect and indirect damage and consequential damage, unrealized savings, as well as damage from delay in delivery, as well as any actions and omissions of the auxiliary persons of P77 Shop, whether contractual or non-contractual.
P77 Shop is not liable for damage that can be traced back to one of the following causes: improper, non-contractual or illegal storage, adjustment or use of the products;
Use of incompatible spare parts or accessories (eg power supply);
neglected maintenance and/or improper modification or repair of the products by the customer or a third party;
force majeure, in particular natural hazards, moisture, fall and impact damage, etc., for which P77 Shop is not responsible, and official orders.

8. Returns and exchanges

You can return any item you have purchased from us within 30 days of receipt of the item if you do not like it, provided that the item is complete, unused, undamaged and in its original packaging. Dirty, used, damaged or opened goods will not be taken back and will be returned to the sender and an administrative fee of 40.00 will be charged. The return costs and the shipping risk to our returns department are to be borne by the buyer in any case. Custom-made products with case printing and special orders in larger quantities at the customer's request are excluded from return.

The statutory warranty regulations apply.

10. Contract language

German is the only contractual language available.

11. Copyright notice

All rights, namely copyrights, to these terms and conditions belong to P77.
Any reproduction, distribution or other use is prohibited and only permitted with the express written consent of P77. If this requirement is violated, P77 reserves the right to take all legal action.
